SetForth Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs use of the SetForth platform and services (the "Service") provided by SetForth, LLC ("SetForth," "we," "us"). It is incorporated into and part of the Terms of Service; capitalized terms not defined here have the meaning given there. The AUP applies to the Customer, all Authorized Users, and anyone who accesses or uses the Service.

The Service runs automated agents that execute code on SetForth-operated infrastructure and on systems the Customer connects, and it stores content the Customer provides. Misuse can harm SetForth, our customers, our providers, and third parties. You are responsible for all activity under your account and for ensuring your use, your content, and your Authorized Users comply with this AUP.

1. Compliance with law and third-party terms (flow-down)

You must use the Service in compliance with all applicable laws and regulations. You must also comply with the terms and acceptable-use or usage policies of any third-party service used to provide or accessed through the Service, including our AI model provider(s) and any code-hosting provider you connect. A violation of those third-party policies through your use of the Service is also a violation of this AUP. Because your activity through the Service is attributed to SetForth by our providers, your compliance protects our ability to keep providing the Service.

2. Prohibited activities

You must not, and must not attempt to, permit, or enable any person to use the Service to:

Illegal and infringing use

  • violate any law, regulation, or third-party right, or promote or facilitate illegal activity;
  • infringe, misappropriate, or violate any intellectual-property, privacy, publicity, or other right, including by connecting, processing, or generating code or content you do not have the rights to use;

Security and integrity

  • create, upload, generate, or distribute malware, ransomware, spyware, or other malicious or harmful code, except for legitimate, authorized security research conducted on systems you own or are expressly authorized to test;
  • gain or attempt to gain unauthorized access to, probe, scan, or test the vulnerability of, or breach the security of any system, network, account, data, or the Service, or any other tenant's environment or data;
  • interfere with, disrupt, or degrade the Service, its infrastructure, or other users, including through denial-of-service attacks;

Circumventing the platform

  • circumvent, disable, or interfere with any access control, authentication, usage limit, rate limit, concurrency limit, metering, billing, or credit mechanism, sandbox or tenant isolation, or the routing of model requests through SetForth's infrastructure;
  • attempt to bypass, manipulate, or defeat the safety features, restrictions, or guardrails of the Service or its underlying models, including through jailbreaking or prompt-injection techniques, or use the Service to attack, manipulate, or extract data from the models or from other tenants;
  • reverse engineer, decompile, or attempt to discover the source code, models, model weights, or underlying components of the Service, or perform model extraction;
  • use the Service or its output to develop, train, or improve a competing product or model, or to benchmark the Service for that purpose;

Abuse of resources / overutilization

  • impose an unreasonable or disproportionately large load on the Service or its infrastructure, or consume resources in a manner inconsistent with normal operation or your plan;
  • use the Service's compute or sandboxes for purposes unrelated to the Service, including cryptocurrency mining, distributed computing, hosting, proxying, or general-purpose workloads;
  • access the Service through automated means in a way that exceeds your plan or is designed to evade usage limits or metering;

Deception and harm to others

  • send spam or unsolicited or unlawful communications, or engage in phishing, fraud, or social engineering;
  • impersonate any person or entity or misrepresent your affiliation, or misrepresent AI-generated output as human-generated where doing so is deceptive or could cause harm;
  • harass, threaten, defame, or harm any person, or violate the privacy of others, including by processing or exposing personal data without a lawful basis.

3. Prohibited content

You must not use the Service to store, upload, process, generate, or distribute content that:

  1. constitutes, depicts, promotes, or facilitates child sexual abuse material ("CSAM") or any sexual content involving minors, including AI-generated material โ€” we report CSAM to the National Center for Missing & Exploited Children and/or relevant authorities as required by law;
  2. exploits, endangers, or sexualizes minors in any way;
  3. promotes, incites, or facilitates terrorism, violent extremism, or mass violence, or the destruction of or attacks on critical infrastructure;
  4. provides instructions for or facilitates the creation of weapons capable of mass casualties, including chemical, biological, radiological, or nuclear weapons or high-yield explosives;
  5. is malicious code or is intended to harm, disable, or gain unauthorized access to systems or data (except authorized security research as described above);
  6. harasses, bullies, threatens, or intimidates any person, or promotes hatred or discrimination against people based on protected characteristics;
  7. promotes or facilitates self-harm or suicide;
  8. is non-consensual intimate imagery, or unlawful sexual or adult content;
  9. is deceptive synthetic or manipulated media ("deepfakes") that falsely depicts real people or events in a manner intended to deceive or cause harm, or that facilitates fraud, disinformation, or election interference;
  10. facilitates fraud, scams, deceptive practices, or the creation of falsified or fraudulent documents or identities;
  11. offers or facilitates illegal goods, services, or transactions;
  12. unlawfully discloses or trades in others' private or personal information; or
  13. infringes or misappropriates any third party's intellectual-property or other rights.

4. High-risk uses and AI disclosure

Output is generated by automated systems and may be wrong, incomplete, or unsafe (see Section 3 of the Terms). Accordingly:

  • Human review for consequential uses. Where you use the Service to support advice, recommendations, or decisions in regulated or high-stakes domains โ€” including legal, medical or mental-health, financial or lending, insurance, employment, housing, education, or safety-related contexts โ€” a qualified person must review the relevant output or decision before it is relied on, disseminated, or finalized. You must not use the Service to make automated high-stakes decisions about individuals without meaningful human review.
  • Disclosure of AI use. Where output is presented to individuals or consumers, or where the Service powers an interface that interacts with people, you must disclose, as and where required by law, that AI is being used.
  • No safety-critical use. You must not use the Service in any context where failure or inaccuracy could lead to death, personal injury, or severe physical, environmental, or property damage (see Terms Section 3.4).

5. No duty to monitor; our right to act

SetForth does not undertake, and has no obligation, to monitor, review, screen, or pre-approve Customer Content, Output, accounts, or use of the Service. However, we reserve the right (but not the obligation), at any time and without prior notice where prior notice is not practicable, to: access, review, and investigate accounts, Customer Content, and activity where we reasonably believe this AUP, the Terms, or the law may be violated, or where necessary to operate, secure, or protect the Service or others; remove, disable access to, quarantine, or refuse to process any content or output; and interrupt, throttle, or stop any activity or running agent.

6. Enforcement; suspension, disabling, and termination of accounts

If we reasonably determine that you, an Authorized User, or your content or use violates or is likely to violate this AUP, the Terms, or applicable law, or creates a security, legal, financial, reputational, or operational risk to SetForth, our providers, or others, we may take any action we consider appropriate, with or without prior notice, including to:

  • issue a warning or require corrective action;
  • throttle, rate-limit, or restrict features or usage;
  • remove, disable, or quarantine content or output;
  • stop or prevent the execution of agents or other activity;
  • suspend, restrict, disable, block, or terminate any Authorized User's access, the Customer's account, or the Service in whole or in part, and delete or deactivate the account and associated content (subject to legal and agreement requirements);
  • revoke access to connected systems and credentials;
  • forfeit Credits as described in the Refund & Billing Policy where termination is for breach; and
  • report the matter to, preserve and disclose information to, and cooperate with, law enforcement, regulators, affected third parties, and our providers.

We will use reasonable efforts to tailor enforcement to the nature of the violation and, where practicable and lawful, to notify you. The severity of the action may reflect the severity, repetition, and risk of the violation; serious violations (including those in Section 3) may result in immediate termination. Enforcement actions taken in good faith under this AUP do not entitle you to any refund or credit and are without liability to SetForth. Suspension or termination does not relieve you of amounts owed, including any negative balance.

7. Copyright and DMCA takedown

SetForth respects intellectual-property rights and responds to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA") and similar laws.

Notice. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at dmca@setforth.app (and, if required, SetForth, LLC, 5900 Balcones Drive, Ste 100, Austin, TX 78731) that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the allegedly infringing material and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Counter-notice. If your content was removed and you believe this was in error, you may submit a counter-notice with the information required by the DMCA.

Repeat infringers. We will, in appropriate circumstances, disable or terminate the accounts of users who are determined to be repeat infringers.

8. Reporting abuse

To report a violation of this AUP, suspected abuse, or security issues, contact abuse@setforth.app (security vulnerabilities: security@setforth.app). Please include enough detail to identify the content or activity (for example, relevant identifiers or URLs).

9. Changes to this AUP

We may update this AUP from time to time as described in the Terms. Changes are effective when posted or as otherwise stated, and your continued use of the Service after they take effect constitutes acceptance.
